I dont think so.
As long as you can have scripts running on a page, you can still have element-behaviours attached.( http://www.naltabyte.se/liquid  )
- Scripts on page cannot be defined as 'plugins' or 'scriptlets'.
Secondly: Where do a 'plugin' begin and a browsers native rendering begin?
It will take a very imaginative point of view to include scripting in this patent.

There's a very interesting discussion on this at W3C, and they all belive that this will be settled.
It's one thing protecting a patent, and another to claim it to extend to areas which are clearly not theirs to claim, and which has no support in an otherwise favorable ruling.

MS says it is going to have to change IE to comply with the Eolas patent case. Scriptlets have been targeted, so I assume element behaviors are in violation as well. So much for custom tags and HTML extensibility. Which is a shame, because this was (imo) dhtml's best shot at becoming a true application platform...
